1.20 How do I get my Earnest Money back??

Q. I want to get my earnest money back, and I want ALL OF IT !! I made an offer on a house with the intentions of living in it not rehabbing it. The offer was accepted, and we had the home inspected. There are a lot of things wrong with the house. It costs more money to repair these things than I can afford, and besides I'd rather buy something worth the money I would have to spend, rrather than put money into the house for major things. The house needs new windows, tuckpointing all around and a new roof. Here is a letter I wrote to the seller, tell me what u think. HELP !!!! All these problems need to be remedied before this transaction can go any further. If the issues are not addressed we will continue on our search for a home. FURNACE The furnace/central air needs to be properly and completely installed and functioning. The furnace needs a shut off valve, and a plastic exhaust pipe. Debris in the "clean out" area at the base of the chimney should be removed as part of system service. PLUMBING The old steel piping is subject to corrosion on the interior of the pipe. As corrosion builds up, the inside diameter of the pipe becomes constricted, resulting in a loss of water pressure. This piping is typically replaced when the loss of pressure can no longer be tolerated. ELECTRICAL Extension cords should not be used as permanent wiring. This wiring should be removed through out the house. Poor connections between newer wiring and the old-knob-and-tube wiring were observed. All connections of this type should be performed within junction boxes, fitted with cover plates. The installation of a ground fault circuit interrupter (GFCI) is required in the kitchen and bathroom. GFCI offers increased protection from shock or electrocution. STRUCTURE Evidence of termite damage was observed and there is risk of additional hidden damage since termites can do a substantial amount of damage. If the property hasn't already been treated, a licensed pest control specialist should be engaged to eliminate further termite activity within the home. All damaged wood should be repaired or replaced. ROOFING The downspout should discharge water at least 5 feet from the house. Storm water should be encouraged to flow away from the building at the point of discharged. Install downspout at left rear section of house. Stairs leading to basement need hand rails. Drop ceiling in same area needs to be repaired. The fireplace needs a damper. All appliances must stay.

A. Well did you make your offer based on it passing inspection or your obtaining financing? Those are two very common terms when putting down earnest money. Did you understand what Earnest Money was? The earnest money is an amount of money that the buyer puts up to show he or she is serious about purchasing the property. The money represents the buyer's commitment to buy and acts as an unofficial option on the property. After receiving an earnest money check, the seller will usually stop showing the property, and wait to see if the buyer can get a mortgage. Earnest money is important to the transaction because it shows the seller that the buyer is operating in good faith (hence the name, "earnest"). The bigger the deposit, the more reassuring it is to the seller, who thinks, "This buyer is serious.'' It also ties the buyer to the property and keeps him or her from looking for additional properties. When Do I Get The Earnest Money Back? If the sale goes through, the earnest money is used as part of the cash down payment and is paid to the seller. If the sale does not go through because of a reason covered by a contingency in the contract (if, for example, the buyer could not get a mortgage), the seller should sign a release of escrow and the earnest money will be refunded to the buyer. The earnest money should also be refunded to the buyer if the sale does not go through because of a problem on the seller's side. If, however, the buyer backs out of the deal for no reason at all, or for a reason that is not covered by a contingency, return of the earnest money may go to the seller. FSBO (For Sale By Owner) Earnest Money If negotiating directly with the seller without the assistance of a Realtor®, never give the earnest money directly to the seller. If you are dealing with a for-sale-by-owner seller who insists upon earnest money before a contract can be executed, write the check to their lawyer or closing attorney or your lawyer or closing attorney, and write fiduciary agent after the lawyers name. This money will then go into a trust, or escrow, account until the negotiations are completed, the contract signed, and all contingencies met. If the deal falls apart, you'll get it back. But if you give the earnest money directly to the seller, you may never see it again, or you may have to go to court to get it back. Good Luck to you.

A. Funny with jobs like this they are not RICH either!!!!! Tax the RICH feed the poor...... Bullshit!

1.20 What are the similarities and differences between carpenter ants and termites?

Q. Do carpenter ants ever come out from behind walls? do they eat anything else besides wood?

A. Found out the hard way. Carpenter ants & termites cause considerable damage to wood. Termites nest & live in the wood they are eating. Carpenter ants nest outside the home & do not generally invade occupied spaces ( at least where you can see them). Would occaisonaly see one or 2 ants where they were coming in. Never saw termites running around , except when they have their wings but, saw some & the damage they were doing during some renovation. Pest control guy told me to pick them up w/ some clear tape so he could identify them & gave me what I needed since a professional whole house de- bugging would be $$$s . My home is block built so the infestation was limited. The garage was another story. The big black carpenter ants had nested in some firewood & had a ball on door framing. The little white grubby termites are harder to deal with. Had success ( I think) by dusting door threshholds w/ a powder I got from the pest control store & getting rid of the rotten firewood.. 1.20 Economy; i don't understand,some help please?

If the economy is so bad, then why does everybody i know, including myself, doing so much better than we were four years ago? we are all in service industry businesses as either small business owners, employees or self-employed sub-contractors. (carpet cleaning, pest control,landscaping, phone sales, trucking etc.etc.) ....people are buying our services! i don't know a single person who's finances have not improved in these last few years. i went from renting an apartment at 500 a month to renting a house at 1000 a month. now i'm getting ready to buy a house and will be able to afford something in the 120 range. 4 years ago i couldn't have dreamt this.

A. I'm not sure what your business is, but my economics Professor actually just discussed this topic a couple of days ago. Although some business are failing, other businesses are thriving on the failed business' customers. And perhaps your business offers a service or goods that are always needed, and therefore you won't be affected unless we went into a depression.

1.20 Help!!!!!!!!! drain flies?

Q. Hi everyone, need a bit of help. got a problem with my drains at the mo, keep blocking from time to time. now i am waiting on dyno rod to come out and do there bit on it in the next 2 weeks. but over the last 3-4 days i have been infested by drain flies (about 100 on the patio dorr today when i came home) i used some industrial drain cleaner to see if it made it better but guess i'll have to wait and see. once dyno rod have been will they go away????? or is it a job for pest control???

A. I would say pour bleach or vineagar down the drain and plug the drain tight. BUT..... You have been using drain cleaner you MUST be careful about mixing chemicals so be careful what you pour down the drain. But plugging the drains will help alot.

1.20 What can I do if one of my tenants has there apartment filthy and piles of debris and clothing everywhere?

Q. The main thing is we were in her unit for something else and happened to notice she had roaches I freaked and called the pest control. i sent her a notice that he was coming to do all 6 units in her building at once and left complete instructions on what she needed to do including clean up the debris but, she didn't do it. Since then he has come again to find the place a disgusting fire hazard with dead bug lying every where. He had to climb over a bike and piles of debris to get in the kitchen the rest of the place was pretty much like that as well. That has got to be a safety issue and fire hazard not to mention the company wont guarantee the service because her unit is so disgusting so we have had to pay 2 times already and working on a 3rd in a week. What can I do? I wouldn't live with bugs so I sure wouldn't expect my tenants too.

A. Your Real property is a business, no different then your local supermarket; your product is Habitable housing. You are also bond by state tenant laws, city codes/laws which applies to both the LL & tenant. First, the easiest think that you could have done is give a 3 day notice to quit; they are not just for late rent. The 3 day notice is to correct/comply with an issue that falls under tenant responsibilities. Next, is to give a 30 day notice to vacate; because she would at that point willfully not complied and now you have incurred costs. You can still do this. Next, the pest company was under no obligation to go into the unit and was actually in your best interest if they didn't; he should have documented on his assessment of the unit that he did not want to enter the unit for the reasons you mentioned. This is your paper trail for compliance, and something you would need to make her paid for additional cost incurred by your business. Now, funny that you mentioned safety & fire hazard issues; this could turn on you for the same reasons you are concerned about the dirty tenant; either by that tenant or other tenants can now claim Habitability issues because of pest; if your all tenant's have children and take that a child to a doctor, and that doctor declares that the pest have infected that child guess who is liable - not the dirty tenant.... So, long advice longer - document, document, document...take picture of the unit, let the tenant know you will be deducting the cost from her security deposit; you may have to consult an attorney on how your state handles depleted security deposits - different rules per state. He may suggest that you give the tenant the entire bill in lew of the security deposit.

1.20 What to put in walls to keep spiders out of house?

Q. I recently had a flood in my house. The restoration company tore everything out, including 2 feet of drywall from the floor up. My whole downstairs is exposed (I can see studs, etc.) Soon they will be patching everything up, but before they do I was wondering if there was anything I could put at the base of the wall to help with spider control. We have so many spiders in our house and this could be a good opportunity to put a barrier down in the walls to help deter them.

A. The best thing to do is ask the restoration company or a pest control company.

Q. What is the best company to control bugs in my house. Dallas area. I had some dude who owned his own company. He would come 2 times a year, spray, and I still had bugs .
